5.G.2. Consequences for a Non-Citizen Registering to Vote

As part of the voter registration process, the registrant must sign a affidavit confirming that they are a citizen of the United States.

If a non-citizens signs a voter registration form, they can face perjury charges, as well as separate state and federal charges for providing false information to vote.

In the Polling Place, the registrant does not have to provide any additional documentation beyond the State's documentation requirements.

The challenger must have personal knowledge (not just a suspicion) of the non-citizenship status of the registrant or elector they challenge.

The challenger has to prove non-citizenship to the satisfaction of the Election Judge, or a majority of Election Judges.

Even with a successful challenge, a registrant will receive an incomplete registration form and be instructed to complete registration at the office of the Election Authority.
