7.C.1. Establishing a Temporary Polling Place in the County Jail
The polling place at the county jail is a Temporary Branch Polling Place.
A poll watcher needs permission from BOTH the county Sheriff and the Election Authority to poll watch in the county jail.
The County Jail is the only election site where a poll watcher needs permission from the Election Authority (i.e., County Clerk or the local Election Board) to be there.
In a county of over three million people, the county shall establish a voting site in the county jail.
In a county of fewer than three million people, the sheriff may establish a voting site in the county jail.
7.C.1.a. Types of Voting Sites
The sheriff and the Election Authority may decide to establish:
- A fully functional polling place, comparable to Student Union Voting at Public Universities.
- A hybrid voting site where vote by mail ballots are delivered to registered voters by Election Judges, comparable to Nursing Homes & Other Care Facilities.
- A voting site without Election Judges or poll watchers, where:
- Vote by mail ballots are delivered to registered voters.
- A voting site comparable to a voting booth are available, where the secrecy of the ballot will not be impinged.
- A system to gather the vote by mail ballots — in a security envelope — and have the vote by mail ballots delivered to the Election Authority.
A poll watcher cannot challenge which method is used.
